Moonstead Terms and Conditions

These Terms form a binding legal agreement between you and Moonstead. They apply whether you are a buyer, a seller, or simply browsing. By clicking “I agree,” creating an account, listing a service, or purchasing a service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, our Seller Policies, and any other policy, disclaimer, or guideline we post on the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Moonstead hosts a marketplace of spiritual, metaphysical, intuitive, and creative services. These services may include, without limitation: tarot, oracle, rune, and other divinatory readings; psychic and intuitive readings; astrology and chart interpretation; numerology; energy work, reiki, and aura-based sessions; chakra alignment; manifestation coaching; affirmation and intention work; ritual, candle, and spellwork offered as spiritual practice; guided meditation and visualization; dream interpretation; and similar spiritual or creative services (collectively, “Spiritual Services”).

You expressly acknowledge and agree that Spiritual Services are provided for entertainment, personal reflection, creative expression, and spiritual exploration purposes only. Spiritual Services are based on subjective interpretation and personal belief systems. They do not represent, and are not presented as, scientific fact, proven method, or professional counsel of any kind. Results are inherently subjective, will vary from person to person, and cannot be measured, verified, or guaranteed.

You use Spiritual Services of your own free will, at your own discretion, and solely at your own risk. Your continued use of the Service confirms that you understand and accept the entertainment-only nature of Spiritual Services.

Spiritual Services are not, and must not be relied upon as:

• Medical or mental health advice. Spiritual Services are not a substitute for consultation with a licensed physician, psychiatrist, psychologist, therapist, counselor, or other qualified health professional, and must not be used to diagnose, treat, cure, or prevent any illness, condition, or disease. If you are experiencing a medical or mental health emergency, call your local emergency number or a crisis line immediately.
• Legal advice. Spiritual Services are not a substitute for the advice of a licensed attorney. Do not rely on readings, rituals, or guidance as direction on any legal matter, including contracts, custody, immigration, criminal, civil, or regulatory issues.
• Financial or investment advice. Spiritual Services are not a substitute for the advice of a licensed financial professional, accountant, or investment advisor. Do not make investment, lending, tax, or other significant financial decisions based on a reading, ritual, or spiritual guidance.
• Advice for life-altering decisions. You should not rely on Spiritual Services for decisions about marriage, divorce, reproduction, medical procedures, the wellbeing of minors, or any other decision that could substantially affect your life or the life of another person. Seek qualified professional advice for such decisions.

By using the Service, you represent that you are not seeking and will not interpret Spiritual Services as professional advice of any kind.

Neither Moonstead nor any seller guarantees any specific result, outcome, prediction, event, or change in circumstance from the use of any Spiritual Service. This includes, without limitation, guarantees related to:

• Love, relationships, reconciliation, or marriage outcomes;
• Fertility, pregnancy, or family outcomes;
• Financial gain, income, career advancement, or lottery/gambling outcomes;
• Health, healing, recovery, weight, or physical appearance;
• Communication with, or messages from, deceased persons, spirits, guides, deities, or non-human entities;
• The thoughts, feelings, actions, or future behavior of any specific third party;
• Protection from misfortune, harm, illness, or death.

Any listing, description, message, or review suggesting that a specific outcome is guaranteed, certain, or scientifically proven is prohibited and may be removed without notice. If you see such a listing, please report it through the Service.

The Service is intended solely for adults. By using the Service, you represent and warrant that:

• You are at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater;
• You have the legal capacity to form a binding contract with Moonstead under the laws of your jurisdiction;
• You are not barred from using the Service under applicable law (including sanctions or export-control laws);
• You will provide accurate, current, and complete information when required;
• You will not use the Service on behalf of any minor or request Spiritual Services about any minor (including readings about a minor’s future, health, or behavior).

We do not knowingly permit persons under 18 to use the Service. If we learn that a user is under 18, we will terminate the account and refund or void any pending transactions in accordance with our refund rules.

Moonstead is a marketplace platform that connects independent providers (“Sellers”) with customers (“Buyers”). Moonstead is not the provider of Spiritual Services, does not perform readings, rituals, or other Spiritual Services itself, and does not employ Sellers. Sellers are independent contractors responsible for their own listings, content, pricing, delivery, and communications.

Any contract for Spiritual Services is formed directly between the Buyer and the Seller. Moonstead is not a party to that contract. Moonstead does not endorse, verify, validate, or guarantee the accuracy, authenticity, quality, credentials, or spiritual abilities of any Seller. Listings, profiles, and reviews are generated by Sellers and Buyers and do not reflect the opinion of Moonstead.

Moonstead provides technology, payment processing (through third-party processors), messaging, moderation, and dispute-resolution tools to support the marketplace. Except as expressly stated in these Terms, Moonstead is not responsible for the conduct, performance, or non-performance of any Seller or Buyer.

You may need to register an account to use certain features. You agree to keep your login credentials confidential and to accept responsibility for all activity that occurs under your account. You must notify us promptly at support@moonstead.app if you suspect unauthorized access to your account.

You may not: (a) create an account using false, misleading, or impersonated information; (b) create more than one account per person without our written permission; (c) allow any other person to use your account; or (d) sell, transfer, or assign your account to any third party. We may require additional identity verification at any time and may suspend accounts that cannot be verified.

When you purchase a Spiritual Service, you agree to pay the listed price plus any applicable taxes, fees, and charges displayed at checkout. Payments are processed by third-party payment providers such as Stripe. By submitting payment information, you authorize Moonstead and its processors to charge your payment method for the total amount shown.

All prices are shown in U.S. dollars unless otherwise indicated. Moonstead may change prices, fees, and payment terms at any time for future transactions; changes will not affect purchases already completed.

Buyers are responsible for any sales, use, or similar taxes applicable to their purchase. Sellers are solely responsible for reporting and paying income, self- employment, and other taxes on their earnings. Where required by law, Moonstead may issue tax forms (such as IRS Form 1099-K) to Sellers through our payment processor.

Moonstead charges Sellers a marketplace fee and/or payment-processing fee, which is disclosed in the Seller Policies or seller dashboard. We may adjust these fees with notice.

Each listing specifies the deliverable format (for example: text report, PDF, audio, video, or live session), estimated delivery window, and scope. The Seller must deliver the Spiritual Service — including readings, reports, and any other deliverable the Buyer paid for — through the Service’s order completion flow (the step that marks the order as delivered), and not by the in-app inbox, outside email, DM, or any other channel, so that delivery can be recorded. Delivering reading content or other paid deliverables through the inbox or any channel outside the order completion flow is a violation of these Terms and our Seller Policies and is subject to account action, including order reversal, payout holds, suspension, or termination.

Acceptance. Once a Seller marks an order as delivered, the order enters a seven (7) day review window. The Buyer is not required to take any action: if the review window elapses without the Buyer requesting a refund or opening a help request, the order is automatically deemed accepted and funds are released to the Seller. The Buyer may end the review window early at any time by requesting a refund or opening a help request through the Service. By making a purchase, you agree that this passive acceptance, by expiration of the review window, releases the Seller’s payout and limits your refund rights as described in these Terms. Moonstead may record delivery-related signals (timestamps, device, IP address, message activity, file access, acceptance clicks) and use them to resolve disputes and respond to chargebacks, as further described in our Privacy Policy.

Refund tiers.

Because Spiritual Services are inherently subjective and are delivered for entertainment and personal reflection, results or feelings about a service are not a basis for refund. However, Moonstead maintains a fair, tiered refund framework:

• Automatic refund. You are entitled to a full refund if: (i) the Seller fails to deliver by the stated deadline plus a reasonable buffer; (ii) the Seller does not respond within their stated response time; (iii) you cancel before the Seller begins work; or (iv) the listing violated these Terms or our Seller Policies (for example, by guaranteeing a specific outcome).
• Mediated refund. If the deliverable is partial, materially different from the listing, or not in the promised format, you may request mediation within the review window. Moonstead will review the listing, the deliverable, and the communication history and may issue a full refund, partial refund, or store credit at its reasonable discretion.
• Post-acceptance. Once an order is accepted, whether expressly or by expiration of the review window, refunds are at Moonstead’s sole discretion and will not be issued on the basis of dissatisfaction with subjective results, feelings, predictions, or interpretations.

Disputes with Sellers.

Buyers and Sellers are expected to communicate respectfully and attempt to resolve concerns directly through the Service’s messaging system before requesting mediation. Moonstead may, at its discretion, mediate but is not obligated to resolve disputes in any particular way.

Chargebacks.

You agree to contact Moonstead and use the in-platform refund flow before initiating a chargeback, credit-card dispute, or bank reversal. Filing a chargeback for a transaction where you have received the Spiritual Service as described may be considered a breach of these Terms. Moonstead reserves the right to (a) contest chargebacks with the delivery records described in Section 9; (b) suspend or terminate accounts that engage in repeated or abusive chargeback behavior; and (c) recover lost funds, fees, and costs from the responsible party.

Refund abuse.

We monitor refund patterns at the account level. Buyers who request refunds at rates materially above the platform average may be limited to single-use purchases, required to provide additional information, or suspended. Sellers who receive refunds, disputes, or chargebacks at rates materially above the platform average may be subject to payout holds, reserves, or removal.

The Service allows you to submit listings, messages, images, audio, video, reviews, profile information, and other content (“User Content”). You retain ownership of your User Content. You represent that you own it or have the rights to submit it and that it does not violate any law, contract, or third-party right.

You grant Moonstead a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting and technical purposes), display, distribute, and otherwise use your User Content for the operation, promotion, and improvement of the Service. This license ends when you or Moonstead delete the User Content, except for (a) copies retained for legal, fraud-prevention, or dispute-resolution purposes, and (b) copies shared with counterparties in a transaction.

Spiritual Services often involve information about people other than the Buyer (for example, a romantic interest, family member, or deceased relative). If you submit any information about a third party, you represent and warrant that:

• You have the legal right to share that information;
• You will not share information that you know to be confidential, medically sensitive, or otherwise protected;
• You will not name or target a minor;
• You will not request Spiritual Services intended to harm, harass, stalk, intimidate, control, manipulate, or overcome the free will of any third party.

You are solely responsible for the third-party information you submit. Moonstead treats third-party information as your User Content for purposes of these Terms and the Privacy Policy. Requests concerning third parties who have not consented may be declined by Moonstead or the Seller.

Please think carefully before sharing sensitive information (for example: health details, bereavement information, birth data, relationship details, financial concerns, or legal matters) in a listing, message, or reading request. You share such information at your own discretion. Sellers are contractually required to treat your information respectfully and to not use it outside the order, but Moonstead cannot guarantee any Seller’s conduct.

All communications between Buyers and Sellers must take place through the Service’s messaging tools. You may not ask another user to move the transaction off-platform, share external payment details, or exchange personal contact information for purposes of completing a transaction outside the Service. Off-platform transactions are not protected by our refund or dispute policies, may violate these Terms, and may result in account suspension.

Fee circumvention is prohibited. Moonstead earns its marketplace fee by facilitating discovery, payment, payout, and dispute resolution. Soliciting, accepting, or arranging payment for a Spiritual Service through any channel other than Moonstead’s checkout — including before, during, or after a conversation initiated on the Service — is a material breach of these Terms, regardless of whether a Moonstead order was ever created. This applies equally to Sellers and Buyers, and to any third party acting on their behalf.

Without limiting the foregoing, the following are prohibited external payment methods and channels for any Spiritual Service offered on or discovered through Moonstead: Venmo, Cash App, PayPal (including PayPal.me), Zelle, Apple Pay (peer-to-peer), Google Pay (peer-to-peer), Wise, Revolut, GoFundMe, Patreon, Ko-fi, Buy Me a Coffee, OnlyFans tips, gift cards or gift-card codes, prepaid cards, wire or ACH transfers, bank deposits, cash, money orders, checks, cryptocurrency or crypto wallet addresses (including Bitcoin, Ethereum, USDC, USDT, and similar), and any other peer-to-peer or off-platform payment instrument. Likewise, you may not direct another user to continue the conversation or transaction on WhatsApp, Telegram, Signal, Discord, Snapchat, Instagram DM, WeChat, KakaoTalk, Line, Kik, Skype, SMS, email, or any other off-platform channel for the purpose of arranging or completing payment.

Violations may result in immediate message removal, withholding or reversal of payouts, charge-backs to the offending account, account suspension or termination, forfeiture of pending earnings, and recovery of the marketplace fees that would have been owed had the transaction completed on the Service. Repeat or coordinated violations may also be reported to applicable payment networks and law enforcement.

Messages may be reviewed by Moonstead or automated systems for safety, abuse prevention, fraud prevention, policy enforcement, and dispute resolution, including automated detection of the prohibited terms and channels described above. Do not use messaging to harass, threaten, defame, or send sexually explicit or otherwise inappropriate content.

Reviews must reflect the reviewer’s honest, good-faith opinion of the transaction and be based on an actual completed purchase. You may not (a) post fake, incentivized, or paid reviews; (b) solicit or coordinate reviews in exchange for refunds, discounts, or other consideration; (c) post reviews on your own listings or on behalf of competitors; (d) use reviews to retaliate, threaten, or harass a Seller or Buyer; or (e) include personal information about third parties in a review.

Moonstead may remove reviews that violate these Terms, appear to be manipulated, or contain prohibited content. Reviews are the opinion of the reviewer and do not represent the views of Moonstead.

You agree not to:

• Violate any law, regulation, or third-party right;
• Use the Service to defraud, deceive, or harm another person, or to launder funds;
• Upload, send, or store viruses, malware, or any harmful or disruptive code;
• Scrape, mine, harvest, or extract data from the Service by automated means without our prior written consent;
• Reverse-engineer, decompile, or attempt to derive the source code of the Service (except to the extent law prohibits this restriction);
• Bypass, disable, or interfere with security, rate-limiting, authentication, or access controls;
• Impersonate any person or misrepresent your affiliation;
• Harass, stalk, threaten, or otherwise violate the legal rights of any user or third party;
• Use the Service in a way that imposes an unreasonable load on our infrastructure;
• Engage in any activity that could disable, overburden, or impair the Service.

Sellers may not list, offer, or deliver any service that:

• Guarantees, promises, or claims a specific outcome, prediction, event, result, or change in circumstance (for example, “guaranteed” love, reconciliation, pregnancy, job, lottery, or financial outcomes);
• Claims to diagnose, treat, cure, prevent, or mitigate any disease, illness, medical condition, mental-health condition, pregnancy, or addiction;
• Offers medical, psychological, psychiatric, legal, tax, accounting, financial, investment, or immigration advice;
• Targets, harms, harasses, curses, hexes, binds, controls, compels, dominates, or attempts to override the free will of any named or identifiable third party;
• Involves, targets, or depicts minors in any way (including readings about a minor’s future, health, or behavior);
• Purports to contact, summon, or deliver messages from a specific named deceased person with certainty or as a guaranteed result;
• Involves blood, bodily fluids, animal sacrifice, or violence;
• Promotes hate, harassment, discrimination, or violence against any group;
• Contains sexually explicit content, solicits sexual activity, or offers romantic/companionship services in exchange for payment;
• Offers, sells, or references restricted or regulated products such as controlled substances, firearms, tobacco, alcohol, prescription medication, or cannabis;
• Infringes intellectual-property rights or uses stolen, stock, or AI-generated images in a way that misrepresents the Seller’s work;
• Violates any law or the rules of our payment processors (including Stripe’s restricted-businesses policy);
• Is structured to evade fees, refund rules, dispute processes, or identity verification;
• Offers multi-level marketing, pyramid structures, or paid-to-recruit schemes.

Certain categories may be permitted subject to review and framing requirements as described in our Seller Policies. Moonstead may remove listings at any time, with or without notice, and may withhold, reverse, or forfeit earnings associated with prohibited listings.

The Service, including its software, design, logos, trademarks, and original content created by Moonstead, is owned by Moonstead or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, publicly display, or create derivative works from any part of the Service without our prior written consent.

The “Moonstead” name, logo, and related marks are trademarks of Moonstead and may not be used without permission.

Moonstead respects the intellectual-property rights of others and expects the same of its users. If you believe material on the Service infringes your copyright, please send a notice to our designated agent at legal@moonstead.app including: (a) a physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material you claim is infringing and information reasonably sufficient to locate it; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.

We may remove material we believe in good faith is infringing and terminate accounts of repeat infringers.

We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, for any reason, including: (a) violation of these Terms or our policies; (b) fraud, chargeback abuse, or refund abuse; (c) creating a risk or legal exposure for Moonstead, users, or payment partners; (d) long-term inactivity; or (e) decisions by our payment partners.

You may terminate your account at any time by following the steps in your account settings or by contacting support@moonstead.app. Termination does not relieve you of obligations arising before termination, including obligations to pay or deliver. Sections intended to survive termination (including Sections 10, 11, 18, 22–28) will survive.

Some jurisdictions regulate, license, or prohibit psychic, fortune-telling, divinatory, or related metaphysical services. You are solely responsible for determining whether your use of the Service, as a Buyer or Seller, is lawful in your jurisdiction. You represent that your use of the Service does not violate any local law, ordinance, rule, or regulation.

The Service is not available to users in jurisdictions where its offerings are prohibited or restricted by law or by our payment processors, including (at this time) Japan, Mexico, Thailand, and any other jurisdiction we designate from time to time. Moonstead may block, restrict, or remove users or listings associated with such jurisdictions.

The Service and all Spiritual Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

To the maximum extent permitted by law, Moonstead disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, and quiet enjoyment. Without limiting the foregoing, Moonstead does not warrant that:

• The Service will be uninterrupted, secure, or error-free;
• Any information obtained through the Service will be accurate or reliable;
• Any Seller’s credentials, claims, abilities, or statements are true;
• Any Spiritual Service will produce any particular result or outcome;
• Any content accessible through the Service is free of viruses or harmful components.

Because Spiritual Services are subjective and offered for entertainment and personal reflection, no warranty, representation, or assurance is made concerning their efficacy, accuracy, or metaphysical reality. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

To the maximum extent permitted by law, Moonstead and its officers, directors, employees, contractors, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages.

Moonstead’s total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid to Moonstead in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise). Some jurisdictions do not allow the limitation or exclusion of certain damages, so the above may not fully apply to you. In such cases, Moonstead’s liability will be limited to the maximum extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless Moonstead and its officers, directors, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any policy referenced herein; (d) your violation of any law or third-party right; (e) any transaction between you and another user; and (f) any decision you make based on a Spiritual Service. Moonstead may assume exclusive control of the defense and settlement of any matter subject to indemnification, and you will cooperate with our defense.

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the [GOVERNING STATE], without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Please read this section carefully. It affects your legal rights.

Binding arbitration. Except for (a) claims for injunctive or equitable relief relating to intellectual property, (b) small-claims matters within the small-claims court’s jurisdiction, and (c) claims otherwise not subject to arbitration under applicable law, you and Moonstead agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER, e.g., JAMS or AAA] under its then-current rules, by a single arbitrator. The seat of arbitration will be [COUNTY, STATE]. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Moonstead agree to bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

Informal resolution first. Before filing arbitration, you agree to send a written notice of the dispute to legal@moonstead.app and to negotiate in good faith for at least 60 days.

Opt-out right. You may opt out of this arbitration section within 30 days of first agreeing to these Terms by sending a written opt-out notice to legal@moonstead.app that includes your full name, email associated with your account, and a clear statement that you wish to opt out of arbitration. Opt-out will not affect any other provision of these Terms.

If any part of this section is found unenforceable, the remainder will continue to apply, except that if the class-action waiver is found unenforceable, this entire Section 26 will be void as to the affected claim.

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting a notice on the Service, updating the “Last updated” date, or sending an email). Changes take effect on the date shown above, and your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.

• Entire agreement. These Terms, together with the Privacy Policy, Seller Policies, and any other policies referenced on the Service, are the entire agreement between you and Moonstead and supersede any prior agreements.
• Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of that provision.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
• No agency. No partnership, agency, joint venture, or employment is created by these Terms. Sellers are independent contractors.
• Notices. We may provide notices by email, by posting on the Service, or by other reasonable means. You are responsible for keeping your email current.
• Force majeure. Moonstead is not liable for delays or failures caused by events beyond its reasonable control.
• Headings. Section titles are for convenience only and do not affect interpretation.
